Social Security Disability Lawyers in Louisville, KY - social security form and card

Louisville Social Security Disability

In Kentucky, only 25 percent of initial Social Security disability (SSD) applications are approved. That means 3/4ths of people who have applied for these disability benefits are turned down. What is the reason for all these denials?

In many cases, the Social Security Administration denies these applications because of technicalities, such as errors in paperwork or failure to provide sufficient documentation. With the help of an experienced disability lawyer, however, disabled workers in Louisville can greatly increase their chances of having their applications approved or receiving full benefits when appealing a denied claim. At Morgan & Morgan, our lawyers understand how to successfully file and appeal SSD claims. We’ve helped hundreds of disabled workers across the country recover government benefits.

If you would like help filing a Social Security Disability application or appealing a denied claim, contact Morgan & Morgan today. Our lawyers may be able to help you collect the compensation you need to support you and your family.

  • What Disability Benefits Are Available to Me?

Depending on your disability, you may be eligible for several types of benefits.

Social Security Disability (SSD) benefits provide compensation to disabled workers for time spent out of work. These benefits may be available for those who have disabilities (illnesses/injuries on the Social Security Administration’s approved list) that are expected to last for at least 12 months AND who have worked for at least five of the previous 10 years. Additionally, disabled workers’ dependents, including children and spouses, may collect SSD benefits.

Supplemental Security Disability (SSI) is a federal income supplement for disabled, blind and elderly workers who have limited incomes and resources. The amount of SSI a worker receives will depend largely on the worker's income history and will vary depending on any income or government benefits the individual already collects. While SSI is paid by the federal government, Kentucky is one of the few states that provide additional, state-funded compensation for disabled workers collecting SSI. Disabled workers living in personal care facilities or family care homes, as well as those who have in-home caretakers, may be eligible for this state-funded supplement to SSI.

Disabled Adult Child (DAC) benefits provide compensation to disabled children ages 18 to 22 whose parents receive SSD benefits or are deceased.

Disabled Widow/Widower (DWB) benefits provide compensation to workers ages 50 and older who developed a disability within seven years of losing their spouse. To qualify for these benefits, disabled workers must have been married for at least 10 years.

  • How Can a Lawyer Help with My Social Security Disability Claim?

By hiring a lawyer, you can greatly increase your chances of receiving Social Security benefits. At Morgan & Morgan, our lawyers can help you:

    • Meet the strict deadlines for filing SSD claims
    • Submit a complete and thorough application on your behalf
    • Keep track of your claim while it is being evaluated
    • Respond to any requests for additional documentation/information on your behalf
    • Evaluate any allotted benefits you are awarded

If your claim is denied, our lawyers can also help you file an appeal. When filing an appeal, your attorney may be able to request:

    • Step One: Reconsideration of your application
    • Step Two: A hearing by an administrative law judge
    • Step Three: A review by the Social Security Administration’s appeals council

The appeals process is made up of four stages. If the final review by the appeals council still results in a denial of your claim, our lawyers can represent you in Kentucky federal court and demand court-ordered benefits on your behalf. Morgan & Morgan has a reputation for being a trial law firm and our lawyers are not afraid to bring their cases to court to help their clients recover the compensation they deserve.

  • How Much Does a Lawyer Cost?

At Morgan & Morgan’s Louisville office, our lawyers will only charge a fee if we are successful in handling your claim. The fee our firm collects will be a percentage of your awarded past-due benefits and is strictly regulated to ensure that disabled workers have affordable options for representation.

If you need help filing an SSD or SSI claim or would like to file an appeal, our lawyers may be able to help.
