What Delaware Residents Can Do To Protect Their Private Information

Since the announcement of the insurance company data breaches caused by MOVEit on June 26th, 2023, as well as other data security events, the state of Delaware’s Insurance Data Security Act was triggered into effect. The Insurance Data Security Act is an additional proactive data security measure required by the state when a data breach occurs. The act ensures the following must occur:

  • There is an investigation of a cybersecurity event and correction of compromised information systems.
  • There are detailed reports sent to the Insurance Commissioner.
  • Consumers who are affected by the breach or cyber security incident are notified within 60 days, except in cases where federal law or law enforcement agencies require or request modified timelines.
  • Consumers must be provided with credit monitoring services at no cost to them for a period of at least one year in addition to receiving information regarding freezing their credit.

Aside from the actions taken by the Insurance Data Security Act, in order to help protect your personal information after a data breach, residents in Delaware should immediately notify their bank that their personal information was accessed during a data breach. This way, your banking institution can take care of your account, noting or flagging any unusual purchases, withdrawals, or actions.

Victims should freeze their credit report to avoid any new activity on their current credit cards account or any potentially new cards opened without their consent. Freezing your credit will also help prevent any other impacting actions from being taken against your social security number. On top of your own monitoring of your accounts, you should also request frequent credit reports to ensure you are up to date with any actions taken on your personal information.

As mentioned in the Insurance Data Security Act, while companies are required to provide victims credit monitoring services, millions of people have been affected, and companies may often take time to roll out these provided services. Until they are able to reach out to you and provide you the security monitoring for added safety, we highly recommend you enroll in identity theft recovery services or a credit monitoring service.
