Creme of Nature Relaxer Lawsuit

Creme of Nature is one of the most popular hair relaxers in the country, especially among Black women. This hair relaxer has been around for over four decades and has made billions of dollars for manufacturers, distributors, marketers, and other parties involved in the production chain. However, just recently, reports have shown the other side of this product many consumers are unaware of.

According to studies, many users of Creme of Nature may have been exposed to cancer-causing chemicals. This is heartbreaking, to say the least. The last thing anyone wants is to catch a life-threatening disease when they're not trying to. Even more disappointing is that the manufacturer of Creme of Nature thought it wise to ignore the health concerns and prioritize profits.

For this reason, someone needs to hold them accountable. And when it comes to holding big companies responsible for their negligence, there’s no injury firm in America bigger than Morgan and Morgan.

FAQ

  • What Are the Harmful Ingredients Found in Creme of Nature Hair Relaxers?

    The Creme of Nature hair relaxer and many other hair products contain endocrine-disrupting chemicals, also known as EDCs. These substances interfere with the body's hormonal system by mimicking, blocking, or altering the natural hormones produced by the body. As a result, they tend to affect various body functions controlled by hormones, such as reproductive and developmental processes, metabolism, and the immune system.

    Exposure to EDCs can occur through ingestion, inhalation, or skin contact. In the case of the Creme of Nature hair relaxer, exposure is usually through heating the hair with a blow-dry. When the relaxer in the hair is exposed to heat, it evaporates, releasing harmful chemicals into the air.

    Anyone who inhales these chemicals is at a higher risk of developing complications from EDC exposure. In other words, you don't even have to wear a Creme of Nature hair relaxer to suffer the consequences of the harmful chemicals these products contain.

    Research has linked exposure to EDCs with many health issues, most notably uterine fibroids, breast cancer, and uterine cancer.

  • What Are Uterine Fibroids?

    Also known as leiomyomas or myomas, uterine fibroids are noncancerous growths that develop in the uterus. Most women with fibroids do not experience any symptoms, but some may experience the following:

    • heavy or prolonged menstrual bleeding;
    • pelvic pressure or pain;
    • frequent urination;
    • difficulty emptying the bladder;
    • constipation;
    • backache; and/or
    • pain during sexual intercourse.

    Severe cases of fibroids can cause infertility. This happens when the growths block the fallopian tubes or stop a fertilized egg from implanting in the uterus.

    Although uterine fibroids are not usually life-threatening, they can seriously impact a woman's quality of life. In some cases, treatment may be necessary, particularly if the fibroids cause severe symptoms or affect the woman's fertility. Treatment options include but are not limited to medication to reduce symptoms, noninvasive procedures such as ultrasound or MRI-guided focused ultrasound surgery, or surgery to remove the fibroids or the entire uterus.

  • How Serious Is Breast Cancer?

    Breast cancer is the most common cancer among women worldwide. The Centers for Disease Control reports that more than 42,000 women die yearly due to breast cancer alone, with 264,000 new cases reported.

    Some common symptoms of breast cancer include the following:

    • A lump or thickening in the breast or underarm.
    • Changes in the size or shape of the breast.
    • Unexplained nipple discharge.
    • Changes to the skin over the breast.

    Breast cancer can be serious, especially if not detected early. Treatment mostly includes surgery, radiation therapy, chemotherapy, or hormone therapy.

  • What Is Uterine Cancer and How Serious Is It?

    Uterine cancer, another potential health risk of using Creme of Nature hair relaxers, is a type of cancer that develops in the lining of the uterus. Also known as endometrial cancer, it is the most common cancer of the female reproductive system.

    Uterine cancer may cause abnormal vaginal bleeding, such as bleeding between periods, after sex, or after menopause. Other symptoms may include:

    • Pelvic pain or pressure.
    • A lump or mass in the pelvic area.
    • Difficulty urinating or having a bowel movement.

    Like breast cancer, uterine cancer is treatable if detected early. The treatment for this type of cancer may include surgery to remove the uterus or other affected tissues, radiation therapy, chemotherapy, or hormone therapy.

  • Can I Carry My Own Child if I Had a Hysterectomy?

    Since a hysterectomy involves the removal of the uterus, you technically cannot carry your own child. That is usually a sad reality for many women diagnosed with uterine cancer following years of using Creme of Nature and other cancer-causing hair relaxers. Remember that the uterus is the organ where a fertilized egg implants and grows into a fetus during pregnancy. Without this organ, carrying a child is impossible, even if you still have your ovaries.

  • What Are Some Statistics About the Risks of Using Hair Relaxer Products?

    Studies all over the country have consistently shown the link between using hair relaxer products such as Creme of Nature and various health complications. Here are some eye-opening statistics worth knowing.

    A study published in the Journal of the National Cancer Institute dubbed the Sister Study found that using hair straightening products regularly puts you two to three times more likely to develop uterine cancer.

    The study examined data from over 33,000 women. Researchers had tracked some of these women for 11 years. Unfortunately, according to the study, the risk of developing uterine cancer somewhat increased even with treatment.

    Published in October 2022, the report also revealed that around 60% of participants identified as Black women. These results supported another report by NBC News indicating a connection between chemical hair straighteners and the increased risk of uterine cancer in Black women.

    Finally, another report found that African American women are three times more likely to develop fibroid than women from other races.

  • How Is Creme of Nature Liable?

    Manufacturers are legally obligated to ensure their products are safe and fit for human consumption. And, importantly, they should warn consumers about the potential risks of using their products.

    But that was not and has not been the case with the manufacturers of Creme of Nature and other cosmetic products. This multi-billion company knew that warning consumers about the potential risks of using Creme of Nature hair relaxes would be disastrous financially.

    Rather, they chose silence. They decided to keep making billions of dollars for decades and turn their backs on the reality of how many women fought and are still fighting for their lives in hospitals, hoping to beat cancer and other diseases acquired from years of using these products.

  • What Should I Do if I Have Been Diagnosed With Cancer After Using Creme of Nature for Years?

    Suppose you have been diagnosed with cancer or any other medical condition discussed above and have a history of using Creme of Nature hair relaxers. You may have a legal case against the manufacturer.

    Here's what to do:

    • Document your symptoms and gather any relevant medical documents to support your claim.
    • If possible, document the frequency and duration of your hair relaxer use as well.
    • Contact a Morgan and Morgan hair relaxer lawsuit attorney for a free, no-obligation case evaluation.

    After reviewing your case, we will help you understand your legal rights and options, including what to do to recover damages.

  • Can I Still File a Claim if I Lost a Loved One Due to Cancer?

    No amount of compensation can replace your loved one, but you can recover damages incurred following the loss. If you lost a loved one after using a Creme of Nature hair relaxer, you could file a wrongful death lawsuit against the manufacturer. However, you must prove that the hair relaxer was the cause of cancer or any other medical condition your loved one succumbed to.

    At Morgan and Morgan, we understand how difficult this might be for you, which is why we are here to help. All you need is a free consultation with us, and we will handle the rest, giving you the time and space you need to recover from the loss.

  • How Long Do I Have to Sue Creme of Nature?

    The short answer is you need to contact an attorney immediately if you or your loved one has been diagnosed with cancer, fibroids, or other related diseases after using Creme of Nature hair relaxer. The longer answer is that the statute of limitations on such claims varies from state to state. Also, some states may allow you to file a claim from the date of discovery, not when you got injured by the product.

    For example, let's say you started using Creme of Nature in 2010 and developed uterine cancer in 2015 but did not know about it until 2020. In that case, the statute of limitations will begin to count from 2020, not 2015, when you first got infected.

    Again, this depends on the specific laws of your state. If your state does not allow the discovery rule, as it is commonly referred to, you may not be able to sue. This further emphasizes the importance of contacting an attorney as soon as possible.

    Also, keep in mind that the longer you take to consult an attorney, the more difficult it is to build a strong case. This applies even if it is common knowledge that the Creme of Nature has been linked with cancer. You must prove that your condition derives explicitly from using the product.
