Mario Badescu Lawsuit

Morgan & Morgan is investigating potential lawsuits on behalf of patients who suffered negative side effects after using Mario Badescu’s Healing Cream or Control Cream.

It has been alleged that Mario Badescu knew or should have known these creams contained steroid ingredients – one of which is only available through a doctor’s prescription – yet failed to list these ingredients on the products' labeling. As a result, those using the Healing Cream or Control Cream have allegedly suffered from side effects of the steroid ingredients including burning, itching, irritation, dryness and inflammation of the skin.

How Is This Different from the Class Action Lawsuit?

In 2013, Mario Badescu agreed to settle claims that it falsely advertised its facial products as a botanically-based skin care line when it failed to disclose that its Healing Cream and Control Cream contained steroids. The class action alleged consumers were misled in purchasing the creams and overpaid for the products. The settlement covers anyone who purchased the products since February 15, 2009 and provides up to two $45 certificates that can be used on the company’s other products or at Mario Badescu’s New York Spa.

Because the products have been linked to serious injuries, our attorneys believe that those who purchased the product and suffered skin injuries may be able to file personal injury suits separate from the class action. These consumers may be able to seek compensation beyond that which was provided by the class action settlement for damages including medical bills and pain and suffering.

Skin Cream Injuries Include Burning, Itching, Dryness

It has been alleged that Mario Badescu’s Healing Cream and Control Cream contain two corticosteroids: hydrocortisone and triamcinolone acetonide, which can only be prescribed by a doctor to treat skin issues stemming from allergies. In addition to general symptoms of irritation, such as burning, itching and dryness, the attorneys at Morgan & Morgan are currently investigating claims on behalf of consumers who experienced the following side effects after using Mario Badescu skin care products:

  • Folliculitis (inflammation of one or more hair follicles)
  • Hypertrichosis (abnormal amount of hair growth)
  • Acneiform eruptions (severe acne, cysts or rosacea)
  • Hypopigmentation (loss of skin color)
  • Perioral dermatitis (tiny red bumps around the mouth)
  • Allergic contact dermatitis (skin inflammation due to an allergic reaction)
  • Maceration (softening and breaking down) of the skin
  • Secondary infection
  • Skin atrophy (thinning of the skin)
  • Striae (irregular areas of skin that resemble bands, stripes or lines)
  • Miliaria (small, itchy rashes)
  • Telangiectasia (small, widened blood vessels on the skin)

Some of these conditions can appear just two to three days after beginning daily use of the skin cream.

Mario Badescu Skin Cream Victims Voice Their Complaints Online

In February 2014, a Mario Badescu skin cream victim created a Facebook page to share her own story and allow others to talk about their experiences with the company’s Healing Cream or Control Cream. The woman who created the Facebook page claims she used Mario Badescu’s Control Cream for six years; however, after purchasing a new bottle of the skin cream in 2013, her skin “began erupting.” She noticed that the new cream had a different texture and smell, and concluded that her “face was not reacting to the new product, rather it was reacting to the abrupt withdrawal of the topical corticosteroids contained in the Control Cream.”

Healing Cream users have reported similar experiences on a product-review website called MakeupAlley. One reviewer claimed that after the Healing Cream was recalled, she began to suffer from “massive steroid withdrawal symptoms” including “itchy, blotchy, even rash- and patch-like symptoms, and hives.” Another reviewer claimed that after not being able to find the skin cream, her “skin quickly became a disaster – a red bumpy, itchy, miserable rash all over.” According to her review, what she “thought were breakouts the cream was controlling, were actually classic rebound reactions from stopping the steroids.”
