  • Does My Employer Have to Pay Me Overtime?

    In Pennsylvania, most employers are required to pay employees overtime for any hours they work beyond 40 hours in one week. Overtime compensation is 1.5x your regular hourly rate. For example, if your regular hourly wage is $10 per hour, your overtime rate after 40 hours in one week is $15 per hour. 

    Pennsylvania laws are similar to the federal laws regarding overtime pay. Similar to the Federal Fair Labor Standards Act (FLSA), employees in Pennsylvania must be paid overtime unless they are exempt. Most employees, whether they’re salaried or not, are entitled to overtime pay unless they perform executive, administrative, or professional duties.

    Yes. If you wish to file a wage claim against your employer, you can do so by filing a complaint with the Pennsylvania Department of Wage and Industry. Once this occurs, if they decide that your wage complaint is valid, the Department will contact your employer and try to help you recover the compensation that is owed to you. If this attempt is unsuccessful, the Department can file a suit against your employer. If your employer fails to pay you within 60 days, you might also be entitled to an additional 25% of the compensation you’re owed.

    Yes. You do not have to file a wage claim with the Pennsylvania Department of Wage and Industry. Instead, you are permitted to hire a lawyer and file a civil lawsuit in court. If your employer allows you to take meal breaks, they are not required to pay you for this time if you do not work during your meal break and its duration is longer than 20 minutes.
