Sarasota, FL Overtime

The state of Florida is a massive tourism hub; it seems like every moment, a new restaurant, bar, or store opens. However, that isn’t always a good thing; in some cases, these employees may face illegal actions, such as being denied earned wages or overtime pay. At Morgan & Morgan, we believe every minute of your day is valuable and you should be fairly compensated.

FAQ

Get answers to commonly asked questions about our legal services and learn how we may assist you with your case.

  • Florida Labor Laws

The Fair Labor Standards Act states that all non-exempt Florida employees (workers eligible for overtime pay) are to be paid an overtime wage 1.5 times their hourly wage for any hours worked over 40 in a weekly pay period. This is called “overtime pay” or “time-and-a-half pay.”

Some employers may exploit your time and cheat you out of your complete and fair wages, despite knowing that the money you earn can be critical to your life.

If you believe you have been wrongfully denied overtime pay from your employer, we may be able to help. Please fill out our free no-obligation case evaluation form to have our Sarasota overtime attorneys review your case.

  • Overtime Lawsuits We Handle

There are many ways your employer may be cheating you out of your fair wages and overtime pay. Below we have listed the cases we have handled for those who have been victims of their employers who violated federal or state law:

    • Improper time tracking: Your employer may not be tracking your full hours every week. This may include asking you to perform specific work tasks off the clock, like checking your work email, being on call, working through your lunch breaks, taking or attending training courses, etc.
    • Tip pooling: When working at a restaurant, those employees who are designated to earn tips (and are paid the tipped minimum wage) may find their tips are illicitly pooled and divided with other employees who are not supposed to earn tips.
    • Wage theft: When an employer does not pay their employee for work that they have performed.
    • Failure to pay minimum wage: The Fair Labor Standards Act (FLSA) states that employees must be paid at least the federal minimum wage of $7.25 per hour; tipped employees must be paid at least $2.13 per hour.
