  • How Does the SSA Define Disability

    The Social Security Administration (SSA) offers 5 criteria to determine your eligibility for benefits. These are:

    1. Make less than $1,260 a month (as of 2020)
    2. Have a restricted ability to perform basic work (walking, lifting, etc.)
    3. Have a condition listed on the SSA’s list of disabling medical conditions (or an equally severe condition)
    4. Be unable to perform any of your past work
    5. Be unable to obtain gainful employment in another field or capacity
  • What is the Appeals Process?

    A denied claim isn’t the end of the road; you could still be eligible for disability benefits. The appeals process is as follows:

    Step 1: Reconsideration

    Our team can file a request for reconsideration with the SSA. This request is reviewed by an SSA claims examiner who wasn’t involved in the initial denial, so as to be able to eliminate bias from the decision-making process.

    Step 2: Hearing

    If the reconsideration request is denied, we can request a formal judicial hearing. At this point, you may be asked for additional evidence or to clarify the information included in your claim. 

    Step 3: Appeals Council

    The judge may not rule in your favor, but we can still request an appeal from the Social Security Appeals Council. The council will review your case and either make a final determination or move it to a judge for additional review.

    Step 4: Federal Court

    If the appeals council doesn’t rule in your favor or decides not to review your case, our team can file a federal lawsuit. You shouldn’t settle for less than you deserve, and neither will we.
