  • How do you prove a product liability claim?

    There are several possibilities in how you prove a product liability claim. The answer depends on whether your case is being argued on the basis of negligence, strict liability, or other issues. Whatever the situation, you usually must prove the following:

    • The defendant designed, manufactured, distributed, or sold a defective/dangerous product;
    • The product had the defect when it left the defendant’s possession;
    • You, the plaintiff, used the product in a way that was reasonably foreseeable; and
    • You, the plaintiff, suffered injuries as a result of the defective/dangerous product 
  • What does reasonably foreseeable mean in this context?

    Under California law, a manufacturer must anticipate how an average person will use a product. They must also consider how the average consumer would misuse a product. This doesn’t create a requirement that the manufacturer must eliminate all risks. However, a manufacturer must take precautions and reasonable measures to reduce the majority of these risks. Ultimately, it’s up to the jury to decide whether the plaintiff’s use of the product was reasonably foreseeable, so this determination can vary from case to case. 

  • Who can be held responsible in Los Angeles product liability cases?

    There are several different parties who can be held liable if you suffered injuries due to a dangerous or defective product. It’s always going to be very fact-specific, so it’s always advisable to speak with an experienced attorney as soon as possible so you can determine if you have a valid claim and who it should be against.
