What Every Undocumented Worker Should Know About Workers’ Compensation Benefits

Workers’ compensation insurance applies to any employee, including undocumented workers. However, the process ahead comes with immense scrutiny because of the undocumented status, and there are some potential hurdles that anyone taking their first steps should know about for protection.

Avoid False Information at All Costs

Every document you provide throughout the process will receive extra attention, so it’s important that you check each to ensure they’re 100% truthful and accurate. This includes the spelling of your name, visa identification information, and your lack of other traditional information, like a social security number. If insurance claim processors discover inaccuracies, they can deny your benefits or, worse, accuse you of fraud.  Importantly, if you do do not have a social security number, do not provide a false number for any purpose, including medical treatment.  Leave any request for a number blank, and if it becomes necessary  to prove some information, write “000-00-0000” or “refuse” in any form that demands a number

You never want to provide information that’s not your own. Insurance claim processors are well-versed in detecting inaccuracies and will quickly use them against you for fraud.  They have extensive databases and inaccurate identifying information will be detected.   The problem, however, is that not everyone submits inaccurate information purposefully.

In some cases, insurance providers can accidentally put a false social security number on your paperwork. You might not even realize it. But, if you don’t redact that number before submitting the document, you’ll face an uphill battle to receive workers’ compensation benefits once they accuse you of fraud.

It’s critical to review everything you receive from your insurance provider and employer throughout this process in detail. If you notice an inaccurate social security number or other personal information on any documents, you must make sure to indicate that it’s false by crossing it out, writing on the form, or asking for a new form entirely.
