Morgan & Morgan Obtains $5.6 Million Settlement for Atlanta Car Crash Victim
[Jonesboro, GA] – Morgan & Morgan attorneys Evan Rosenberg, Keith Mitnik, John Morgan, Riley Snider and Edward Hardrick obtained a $5.6 million post-verdict settlement Monday for a 40-year-old Georgia man. The settlement came after a Clayton County jury had awarded the plaintiff a $3,750,000 verdict on Friday for injuries he suffered in a 2018 car crash. State Farm, the defendant driver’s insurance company, did not offer to settle the case until after the jury found the defendant liable and delivered the multi-million-dollar verdict.
On November 4, 2018, the plaintiff was driving south on Interstate 75 through Clayton County when the defendant driver rear-ended him, causing a disc herniation in his neck for which he had a cervical disc replacement surgery.
“This is a man who has a lot of life left to live, and the jury recognized that his future medical care would present a significant financial burden for him if they did not step in and deliver justice,” said Morgan & Morgan attorneys John Morgan and Evan Rosenberg. “State Farm fought us at every turn, but we presented all the facts, including evidence that demonstrated clearly the defendant driver’s responsibility for the crash as well as testimony from our client’s doctor, which drove home how his injury will impact him for the rest of his life. We’re pleased about this result and are optimistic our client will be able to move on with his life.”
The ultimate amount of the post-trial settlement exceeded that of the verdict due to Georgia laws that allow plaintiffs to recover attorney’s fees and litigation expenses when the final judgment in a civil case is greater than 125 percent of the plaintiff’s settlement offer. State Farm offered $0 to settle the case after closing arguments.
The case was heard by Judge Sonyja George, Case No. 2019-CV-02133. State Farm hired Karl Broder of Beck Owen & Murray and Valencia Flakes of Gobel Flakes LLC to represent the defendant.
