Morgan & Morgan’s industry-leading data privacy attorneys are investigating New York Blood Center Enterprises (“NYBCe”) regarding its recent data breach (which may be referred to as a “data event” or “data security incident”). The NYBCe data breach involved sensitive personally identifiable information that may have been exposed to an unauthorized individual.

We are investigating, among other things, the following:

  • how NYBCe acquired the sensitive information;
  • whether NYBCe should have had the sensitive information;
  • whether and, if so, why NYBCe stored this sensitive information in an Internet-accessible environment;
  • whether NYBCe encrypted the sensitive information;
  • whether NYBCe deleted sensitive information it no longer had a reasonable need to retain;
  • whether NYBCe implemented appropriate and adequate security measures to protect sensitive information; and
  • whether NYBCe has provided affected individuals adequate protection and compensation for any harms they have experienced as a result of the data breach.

NYBCe is one of the largest non-profit, independent, community-based blood centers in the U.S. that works with hundreds of hospitals and many research institutions and biopharmaceutical companies in providing high-quality blood and stem cell products. On or around January 26, 2025, NYBCe became aware of a ransomware attack on its systems that may have resulted in unauthorized access to and/or acquisition of personal information. Recently, NYBCe disclosed information about the breach on its website.
