New York’s Credit Card Surcharge Law was instated in 2023 to protect consumers, ensuring everyone is clearly informed of any credit card surcharges before they select their method of payment to complete a transaction.

This new law requires businesses to post the total price of an item or service—including the credit card surcharge amount—before checkout. Alternatively, businesses can post the credit card price alongside the cash price before checkout, giving consumers a clear understanding of the difference, if any.

Not every business, however, is following the rules.
