Family Awarded $3.2 Million After Tragic Accident - pedestrian crossing

Lynx, an Orlando based bus company, lost not just its money, but also its reputation last year when one of the its drivers ran over two boys as they were walking across a pedestrian cross walk. Both boys were caught under a bus and tragically, only one survived.

On June 11, 2015, the victims’ family was awarded $3.2 million for Lynx’s negligent behavior.

Mathew and Mark Robinson were crossing the road when the bus struck them. They were caught under it and Matthew, who was crushed by the rear wheel, died instantly. Kissimmee police conducted an investigation and gathered information about the stop signs, traffic lights, and whether the children had pressed the cross walk light button before crossing the road. According to the police, the boys had the right of way.

The lawsuit states that the incident was not the bus driver’s first case of negligent driving. Fernando Vega had previously caused six accidents, all of which could have been prevented. He was fired after the company investigated the circumstances regarding the accident.

Mark Robinson now suffers from spondylolisthesis, a condition in which a person’s vertebra slides out of position in his or her spinal column. The condition can cause severe back pain and nerve numbness. The boys’ mother, Sharon Robinson, has been suffering from post traumatic stress since the incident. The lawsuit hopes to procure compensation for the family members so that they may have access to mental and physical support.

The company eventually stated that it was responsible for the accident. Gov. Rick Scott signed the settlement bill, which ordered Lynx to provide $3.2 million in damages to the family.

When a car accident is not the a person’s fault, he or she can pursue a lawsuit against the negligent parties involved. This can be the driver, the company the person works for, and/or the insurance company involved. In the case of the victim’s death, his or her family may be able to pursue a wrongful death lawsuit.
